All artists who currently have, or intend to have, a professional career in the arts with dealer/gallery relationships are strongly encouraged to attend this panel. Understanding Artists’ Rights in Dealer Relationships

The Parsons Institute for Intellectual Property (PiiP), in partnership with the Art Law Committee of the New York City Bar Association, will present a panel discussion entitled “Understanding Artists’ Rights in Dealer Relationships.” Recent events, such as the bankruptcy of the Salander-O’Reilly Galleries, have highlighted the need for artists to protect their ownership rights in works of art they consign to galleries for sale, and to be especially vigilant in ensuring that they receive a timely accounting and the proceeds from the sale of their consigned works. Among the topics covered in this informative evening will be:

• What terms should be included in an artist/dealer agreement?

• What rights does an artist have when a gallery sells an artist’s work and fails to deliver the sale proceeds to the artist?

• Are there any tools available to alleviate the substantial legal fees an artist might incur to enforce her rights?

Panelists:

Stacy Lefkowitz, the Director of Legal Services comes from a nonprofit and arts background. She manages the day-to-day legal services at Volunteer Lawyers for the Arts, provides legal advice to artists and arts organizations manages the placement of pro bono cases and teaches core arts-related legal curriculum.

Dean Nicyper is a partner at the law firm Flemming Zulack Williamson Zauderer LLP, and heads the Art Law practice there. He has worked with auction houses, galleries, museums, artists, collectors and dealers in art-related disputes and transactions for more than 17 years. Dean is the Chair of the New York City Bar Association’s Art Law Committee.

Michelle Bogre, the founder of the Parsons Institute for Intellectual Property, teaches copyright law and photography at Parsons The New School for Design. She will moderate the panel.
